Ownership of land could include ownership of all the air above it.
Ownership of three-dimensional blocks of atmosphere could be bought and sold in a market.
Existing frequent users of the atmosphere, such as airlines, might state a claim to own certain corridors (eg 20 miles wide, 3 miles deep, from City A to City B) and establish them in court if and when challenged.
